Terms & Conditions

PMV is a web-based immersive 3D platform that enables organizations to create, manage, and deliver interactive digital experiences for onboarding, learning, training, engagement, and related use cases through configurable interactive modules.

• You must be at least 18 years old and legally capable of entering into binding agreements.
• If you use PMV on behalf of a company or organization, you represent and warrant that you are authorized to bind that entity to these Terms.
• You agree to provide accurate and complete information when creating or managing an account.

Administrators are responsible for:

• maintaining the security of their accounts,
• managing user access,
• distributing shared module links,
• and ensuring that authorized users comply with these Terms.

Members may only access modules specifically assigned to them.

Anyone with a public access link can access your module without creating an account. These sessions may be tracked for analytics and platform improvement purposes.

You are responsible for all activity occurring under your account or shared access links.

We reserve the right to suspend, restrict, or terminate access where we reasonably believe there has been:

• unauthorized access,
• misuse of the platform,
• security risks,
• or violations of these Terms.

PMV offers both Free and Paid licenses. Available features, limitations, and pricing are displayed on the Pricing page.

Billing

• Paid subscriptions are billed on a recurring monthly or annual basis depending on the selected plan.
• Upgrades, downgrades, or cancellations take effect at the beginning of the next billing cycle unless otherwise stated.

Payments

Payments are securely processed through Stripe. PMV does not store raw payment card information. By purchasing a subscription, you also agree to the applicable Stripe terms and policies.

Failed Payments

If payment cannot be successfully processed, PMV may suspend or restrict access to Paid features until payment is resolved.

Pricing Changes

We may update pricing or plan structures from time to time. Any pricing changes will apply from the next renewal cycle following notice.

Refunds

Unless otherwise required by applicable law, subscription fees are non-refundable, including for partial billing periods or unused features.

You retain ownership of all content uploaded to PMV, including documents, videos, images, PDFs, quizzes, and other materials (“User Content”).

By uploading User Content, you represent and warrant that:

• you own or have all necessary rights to use and upload the content,
• the content does not infringe any intellectual property or third-party rights,
• and the content does not contain malicious code, unlawful material, or harmful content.

You grant PMV a limited, non-exclusive license to host, process, display, and transmit User Content solely for the purpose of operating and providing the platform services.

We reserve the right to remove or restrict access to content that violates these Terms or applicable law.

Indemnification

You agree to indemnify and hold harmless GameIN FZ LLC, its affiliates, employees, directors, and agents from any claims, liabilities, damages, losses, or expenses arising from:

• your User Content,
• your use of the platform,
• or your violation of these Terms.

You agree not to:

• use the platform for unlawful or fraudulent purposes,
• attempt unauthorized access to systems or accounts,
• interfere with platform security or infrastructure,
• upload harmful, infringing, defamatory, or illegal content,
• distribute malware or malicious software,
• reverse engineer, reproduce, or exploit the platform without authorization,
• scrape, extract, or harvest platform data without written consent,
• or violate applicable laws or regulations.

Certain PMV features may include AI-powered functionality.

AI-generated outputs are based on uploaded reference materials and automated processing. While PMV aims to improve response quality and relevance, AI outputs may not always be complete, accurate, or suitable for every use case.

You are solely responsible for reviewing and validating AI-generated outputs before relying on them operationally or commercially.

AI-generated content does not constitute legal, financial, medical, or professional advice.

Use of PMV requires:

• a compatible device,
• a supported web browser,
• and a stable internet connection.

Users are responsible for maintaining compatible hardware, software, and connectivity.

PMV is not responsible for performance limitations caused by unsupported devices, outdated software, or network conditions.

PMV may integrate with third-party providers, including payment processors, AI providers, analytics tools, hosting services, and cloud infrastructure providers.

We are not responsible for the availability, performance, security, or practices of third-party services.

Your use of third-party services may also be subject to separate terms and privacy policies.

All rights, title, and interest in PMV — including its software, interfaces, platform architecture, branding, designs, visual assets, and immersive modules — remain the exclusive property of GameIN FZ LLC and its licensors.

Except as expressly permitted, you may not:

• copy,
• modify,
• distribute,
• reproduce,
• sublicense,
• reverse engineer,
• or create derivative works from the platform.

No ownership rights are transferred to you through use of the platform.

Each party agrees to protect confidential information disclosed in connection with the platform and not disclose such information to third parties except:

• as required by law,
• with prior written consent,
• or as necessary to provide the services.

PMV will not use uploaded User Content for purposes unrelated to delivering the platform services.

PMV may update, modify, suspend, or discontinue any feature or portion of the platform at any time.

While we strive to maintain reliable availability, PMV is provided on an “as available” basis without guarantees of uninterrupted or error-free operation.

Force Majeure

GameIN FZ LLC shall not be liable for delays or failures resulting from causes beyond reasonable control, including:

• cyberattacks,
• infrastructure failures,
• internet outages,
• natural disasters,
• government actions,
• or third-party service disruptions.

PMV may retain account data, uploaded content, analytics records, and module configurations after subscription cancellation or account inactivity.

During inactive or unpaid periods, access to certain platform features or modules may be restricted until the subscription is reactivated.

GameIN FZ LLC reserves the right to permanently delete inactive accounts or stored data after an extended period of inactivity, where permitted by applicable law.

Administrators are responsible for maintaining their own backups of important content and records.

To the maximum extent permitted by applicable law, GameIN FZ LLC and its affiliates shall not be liable for:

• indirect,
• incidental,
• consequential,
• special,
• punitive,
• or exemplary damages,

including loss of profits, revenue, business opportunities, goodwill, or data.

PMV’s total aggregate liability arising out of or relating to the platform shall not exceed the total amount paid by you to PMV during the twelve (12) months preceding the event giving rise to the claim.

Your use of the platform is at your own risk.

You may stop using PMV at any time.

We may suspend or terminate access immediately if:

• these Terms are violated,
• platform misuse is detected,
• payment obligations are not fulfilled,
• or security or legal risks arise.

Upon termination:

• access rights immediately cease,
• active subscriptions remain payable until the end of the billing cycle,
• and sections intended to survive termination shall remain in effect.

We may revise these Terms from time to time.

Where material changes are made, we will provide reasonable notice before the updated Terms become effective.

Continued use of PMV after the effective date constitutes acceptance of the revised Terms.

These Terms are governed by the laws of the United Arab Emirates.

Any dispute arising out of or relating to these Terms or the use of PMV shall be subject to the exclusive jurisdiction of the courts of the United Arab Emirates.
